Important Update on the German Lkw-Maut Claim: Do Not Let 2022 Become Time-Barred!

We hereby inform you of an important development regarding the German Lkw toll (Lkw-Maut).

2022 at risk of becoming time-barred – action required

For the year 2022, a strict statutory limitation period applies. At this moment, it is important that you indicate that you do not wish to allow the year 2022 to become time-barred if (additional) refunds should arise. For this reason, we are sending you this email.

Without timely action, 2022 will become definitively time-barred, and a later positive ruling will offer no possibility of recovery. There are currently approximately 15 days remaining to safeguard your rights.

Expected ruling in the appeal

Based on earlier rulings by the European Court of Justice, the OVG Münster, and the ongoing proceedings before the Verwaltungsgericht Köln (case VG Köln 14 K 6556/20), a ruling in the appeal filed by Toll Collect is expected in 2026.

Recent developments in this procedure indicate that BALM may not have substantively adjusted the costs included in the Lkw-Maut, but instead continued them under a different designation. This cost structure is fixed until 2027.

As a result, the expected ruling could have far-reaching consequences for the years 2022 through 2027, potentially leading to additional refunds of German Lkw-Maut.

What can you do now?

Via the Transport in Nood portal (CRM), you can easily download a standard letter. This letter has been drafted by our German attorney, is completely free of charge, and is solely intended to safeguard your rights for 2022.

You must send this letter by registered mail (!) to BALM and then upload the sent letter back into the portal.

By doing so, the year 2022 is legally secured, while we continue to monitor the ongoing proceedings and the appeal.

Voluntary refunds have started

Voluntary refunds for the period October 2020 through October 2021 have now begun. Several customers have already received (partial) refunds, and further payments are expected in the coming months. This underlines that the Lkw-Maut claim is no longer theoretical, but is actively being implemented.
