In verschillende landen wordt momenteel fors beboet op het houden van de weekendrust in de cabine. Ook in Nederland is de “waarschuwingsperiode” voorbij en worden er boetes uitgedeeld.

Onze ervaring was dat er alleen boetes uitgeschreven werden voor overtredingen die op “heterdaad’ vastgesteld werden, of voor overtredingen die in het betreffende land begaan zouden zijn. Echter zijn er nu ook boetes voorbij gekomen voor het houden van de weekendrust in de cabine in een ander land. Zo heeft een transportbedrijf een boete gehad in België t.w.v. € 1.800,-, omdat de chauffeur de weekendrust in Duitsland in de cabine gehouden zou hebben. Ook heeft een transportbedrijf twee boetes gekregen in Frankrijk van € 750,- per stuk, omdat de chauffeurs in Spanje 45 uur in de cabine gerust hadden.

Het lijkt zo te zijn dat deze boetes uitgeschreven worden als door de chauffeur niet aangetoond kan worden dat hij op een andere plek dan de cabine geslapen heeft. Mocht je de weekendrust niet thuis doorbrengen, zorg dan dat er aangetoond kan worden dat de rust niet in de cabine gehouden is d.m.v. de rekening van het pension of hotel. Rust je in het buitenland bij kennissen of vrienden, zorg dan voor een foto met locatie of iets dergelijks. Met onze app Legal Control is een foto te maken die een tijd en GPS stempel meekrijgt.

 

De verkorte wekelijkse rust is in de cabine nog wel toegestaan. Onze ervaring in Engeland leert dat de normale weekendrust op een verzorgingsplaats met voldoende voorzieningen wel toegestaan/gedoogd wordt.

Transport in Nood heeft de tip gekregen om nog even het onderstaande Franse nieuws te delen. Frankrijk heeft maatregelen genomen om “de omgeving” beter te beschermen als het gaat om ongevallen met gevaarlijke stoffen. Zo mogen vrachtwagens met ADR niet langer dan 12 uur geparkeerd staan binnen de bebouwde kom.

“De nieuwe maatregelen gaan onder meer over het parkeren op de openbare weg van meer dan twaalf uur. Binnen de bebouwde kom is dit niet toegestaan en buiten de bebouwde kom moet een minimale afstand van vijftig meter worden gerespecteerd ten opzichte van woningen, publiek toegankelijke instellingen of andere voertuigen die ontvlambare stoffen vervoeren.”

In several countries, there is currently a considerable fine on keeping the weekend rest in the cabin. Also in the Netherlands the “warning period” is over and fines are handed out.
Our experience was that penalties were only issued for violations that were found in “the act” or for violations that were committed in the country in question. However, fines have now also passed for keeping the weekend rest in the cabin in another country. For example, a transport company had a fine in Belgium of € 1,800.-, because the driver would have had the weekend rest in the cabin in Germany. A transport company also received two fines in France of € 750.- each, because the drivers had rested for 45 hours in the cabin in Spain.

It appears that these fines are issued if the driver can not prove that he has slept in a different location than the cabin. If you do not spend the weekend rest at home, make sure that it can be proved that the rest is not kept in the cabin. The invoice of the guest house or hotel have to be sufficiënt. If you are resting abroad with acquaintances or friends, take care of a picture with a location and time stamp or something similar to prove that you were not spendng the weekend in the cabin. Our experience in England shows that the normal weekend rest at a care facility with sufficient facilities is allowed/tolerated.

Transport in Nood has received the tip to share the following French news. France has taken measures to better protect “the environment” when it comes to accidents involving hazardous substances. For example, trucks with ADR can not be parked in built-up areas for more than 12 hours. “The new measures include parking on public roads for more than twelve hours. This is not permitted in built-up areas and a minimum distance of fifty meters must be respected outside built-up areas in relation to homes, publicly accessible institutions or other vehicles that transport flammable or toxic substances. “
