WEEKENDRUST IN DE CABINE – VERVOLG

Naar aanleiding van ons bericht van 12 februari 2018 hebben wij veel vragen ontvangen. Het bericht ging over het feit dat er verschillende boetes zijn uitgeschreven, omdat chauffeurs niet konden aantonen dat zij op een andere locatie de weekendrust (45 uur) hadden gehouden dan de cabine. Ons advies was daarom ook om te zorgen dat er altijd aangetoond kan worden dat je niet in de cabine gerust hebt.
Nu zijn wij door Kevin Vierhout van Vallenduuk Advocaten geattendeerd op het feit dat de politie helemaal geen documenten mag opvragen die moeten bewijzen dat de rust niet in de cabine gehouden is. Artikel 34 lid 3 van de tachograafverordening (165/2014) zegt daarover:
“De lidstaten mogen de bestuurders niet verplichten tot het overleggen van documenten ter staving van hun bezigheden wanneer zij zich niet bij het voertuig bevinden.”
De chauffeurs mogen niet in het voertuig zijn, dus mag men ook niet vragen om documenten om dat te bewijzen. De twee boetes in Frankrijk, die in het vorige bericht genoemd werden, klopten achteraf eigenlijk wel. Nadat zij geen documenten konden overleggen, hebben de chauffeurs toegegeven dat zij in de cabine gerust hebben.

Weekend rest in the cabin – continued
In response to our message of 12 February 2018, we received many questions. The newsletter was about the fact that several fines were issued because drivers could not prove that they had held the weekend rest (45 hours) at a different location than the cabin. Our advice was therefore to ensure that it can always be demonstrated that you did not rest 45 hours in the cabin.
Now we have been alerted by Kevin Vierhout of Vallenduuk Advocaten to the fact that the police can not request any documents that have to prove that the rest is not kept in the cabin. Article 34, paragraph 3 of the tachograph regulation (165/2014) states:
“Member States may not require drivers to submit documents in support of their activities when they are not at the vehicle.”
The drivers are not allowed to be in the vehicle, so one can not ask for documents to prove it. The two fines in France, which were mentioned in the previous message, were actually correct afterwards. After they could not submit documents, the drivers admitted that they have rested in the cabin.
