Update: Developments regarding Danish toll fines

The first companies have now received the new fines from the police court in Denmark. This is the next step in the procedure, after the Færdselsstyrelsen (Danish Road Traffic Authority) closed the case and forwarded it. It is noteworthy that the authorities recently called several companies for a so-called ‘interview’. They asked why no toll had been paid or even why a fine had been imposed.

We would like to emphasise that this is not permitted. In this case, authorities are not allowed to ask companies questions directly in ongoing cases – regardless of whether a lawyer is involved or not.
 
Our advice:

  • If you receive a call from the authorities, do not respond. Refer them directly to Transport in Nood at +31 85 0719 600. We will be happy to take over the conversation (together with our lawyer) on your behalf. 
  • If you receive a new letter about the toll fine, always forward it to us immediately at boete@transportinnood.nl. Even if you have already conducted the first appeal procedure yourself, we can handle the second procedure for you.
  • The general advice remains not to pay the fines as this may weaken your legal position.

In this way, we ensure that your rights are protected and that the procedure is conducted correctly.
