Claim Your Refund on Spanish Fuel Tax
Did your transport company purchase diesel or petrol in Spain between 2013 and 2018? If so, you may be entitled to a refund from the Spanish tax authorities!
Both the European and Spanish courts have ruled that part of the Spanish fuel tax – specifically the so-called “autonomous part” of the IEH (Special Hydrocarbon Excise Duty) – was levied unlawfully.
As the courts confirmed the illegality of this tax, we are organizing a group claim in collaboration with our trusted partner and with the support of KPMG Spain. This claim is on a no cure, no pay basis – the percentage to be charged upon success will be disclosed later.
Transport in Nood charges an administration fee of €75 for members and €150 for non-members.
🔍 What’s the issue?
Between 2013 and 2018, Spain imposed an additional regional fuel tax in several areas. This so-called "autonomous tax" has now been declared invalid by both the European Court of Justice and the Spanish Supreme Court.
Companies that purchased fuel in Spain during this period can recover part of their expenses through legal proceedings.

📍 Which Spanish regions are included?
Here is a map of Spain – only fuel purchased in the green regions is eligible for the claim.
❌ Important: La Rioja and the Basque Country (País Vasco) are excluded from this claim. ( The red areas on the map)
💰 The overcharged tax ranges from 1 to 4 cents per liter (Click here for more information).
Minimum Participation Requirement
For foreign (non-Spanish) companies, a minimum fuel consumption of 360,000 liters between 2013 and 2018 is required.

How can you participate?

- Complete this Excel form and email it as soon as possible to fuel@transportinnood.nl
- Starting May 1st, you will be able to upload your invoices or other proof of fuel purchases in our CRM portal.
No invoices? You can request them from your distributor or fuel supplier.
Important: The deadline to submit the Excel file and invoices is May 15, 2025
