The Danish association ITD – International Transport Denmark has officially filed a complaint with the European Commission. The reason? Denmark’s method of imposing toll fines violates EU legislation.
At Transport in Nood, we’ve been warning about this issue for quite some time. Now it’s officially confirmed: the fixed fine of DKK 4,500 imposed by Denmark for toll violations is illegal.
According to EU law, fines must be proportionate to the nature of the offence. This principle was reaffirmed by the European Court of Justice in 2024. A fine cannot be issued without considering human or technical errors. Yet this is exactly what Denmark continues to do – over and over again, without distinction or nuance.
What is Transport in Nood going to do about this?
To strengthen our position and push back against this wave of fines, we want to gather as many toll fines as possible and submit them to our legal team. It is important that fines which have already been paid (with payment confirmation), have been appealed, or have been rejected are also included in this case. Ofcourse, new fines are also important.
Please note: This action does not replace the process of appealing! We still recommend that you file an appeal against these fines and we can assist with that if needed.
