Update on Danish Toll Fines – Do NOT Pay These

Dear client,
Further to our previous news update, we would like to share the following advice from our lawyer:

Do not pay the Danish toll fines!
(Even if you receive a reminder.)

Why not?

• We suspect that Denmark is acting in violation of European legislation
• The fine of 4,500 DKK is disproportionate
• The complaint from the Danish transport association ITD is now officially filed with the European Commission
• The case could result in a ruling by the European Court of Justice
• Over 25,000 fines have been issued in just three months

What happens if you don’t pay?

The Danish authorities will send the unpaid fine:

1. To the public prosecutor
2. Then to the court, which will assess the validity of the fine
3. Only if the court confirms the fine Denmark can try to collect it

This process is expected to take quite some time.
During that time, we expect a ruling that could potentially overturn all fines

What is Transport in Nood doing?

Together with our lawyer, we are building a strong case to put an end to the large number of fines being issued.
That’s why we are collecting all fines, even if they have already been paid, appealed, or rejected.

Include:

• The status of the fine (paid, appealed, new, etc.)
• Whether you would like us to file an appeal (we can do this for you, and it is separate from the collective legal case against Denmark)
